As of today T-Mobile will be raising their per-minute overage rates across the board.
The rate for per-minute overages will be raised from $.40 to $.45 per minute on individual plans $59.99 and lower with family plan overage rates increasing to the same on plans priced at $89.99 and lower. Overage rates will also be increased for individual and family plans higher than $59.99 and $89.99 respectively to $.40.  These aforementioned changes in terms will allow you to cancel your contract without paying Early Termination Fees as it constitutes a material change in the agreement directly imposed by the carrier.
Verbiage From T-Mobile Contract:
Changes to the Agreement or Charges. EXCEPT TO THE EXTENT PROHIBITED BY LAW, IF WE: (A) INCREASE THE CHARGES INCLUDED IN YOUR MONTHLY RECURRING ACCESS RATE PLAN, OR (B) MODIFY A MATERIAL TERM OF OUR AGREEMENT WITH YOU AND THE MODIFICATION WOULD BE MATERIALLY ADVERSE TO YOU, WE WILL NOTIFY YOU OF THE INCREASE OR MODIFICATION AND YOU CAN CANCEL THAT SERVICE WITHOUT PAYING A CANCELLATION FEE (WHICH IS YOUR ONLY REMEDY) BY FOLLOWING THE CANCELLATION INSTRUCTIONS IN THE NOTICE. IF YOU DO NOT CANCEL YOUR SERVICE BY FOLLOWING THOSE INSTRUCTIONS, OR YOU OTHERWISE ACCEPT THE CHANGE, THEN YOU AGREE TO THE INCREASE OR MODIFICATION, EVEN IF YOU PAID FOR SERVICE IN ADVANCE. IF THE NOTICE DOES NOT SAY HOW LONG YOU HAVE TO CANCEL, THEN IT IS WITHIN 14 DAYS AFTER THE DATE OF THE NOTICE, UNLESS A LONGER PERIOD IS REQUIRED BY LAW. EXCEPT TO THE EXTENT PROHIBITED BY LAW, CHARGES FOR PRODUCTS, SERVICES, OPTIONAL SERVICES, OR ANY OTHER CHARGES THAT ARE NOT INCLUDED IN YOUR MONTHLY RECURRING ACCESS RATE PLAN (SUCH AS DIRECTORY ASSISTANCE, ROAMING, DOWNLOADS, AND THIRD-PARTY CONTENT) ARE SUBJECT TO CHANGE AT ANY TIME WITHOUT NOTICE, AND IF YOU CONTINUE TO USE THOSE SERVICES, OR YOU OTHERWISE AGREE TO THE CHANGES, THEN YOU AGREE TO THE NEW CHARGES. In order to cancel successfully, it is advised to call and speak to a representative quoting the changes. If the representative refuses to allow termination without the ETF after explanation and gathering information related to the change, escalate to a supervisor or hang up and call back if hitting a dead end, as many representatives will not be aware of the changes initially.

As a tmobile csr i do want to point out that this change doesnt effect most customers. Those effected were mailed letters last advising of the change.

As usual, we have noted countless times where a carrier “forgot” to notify many affected customers, and then refused to let them out of contract later.
We encourage everyone to call T-Mobile customer service and ask them directly if they are affected.
You bet your ass I’m trying this tomorrow morning! I’ve been looking for a way out of my contract!
Just to let you guys know, I just got off with T-Mobile and I got out of my contract. My phone is actually already shut off. I argued saying that I got a new job which caused me to use my phone more (which was a lie), and that I’d be getting screwed over in overage charges. Once I asked to speak to a manager, I was put on hold. The same rep. came back moments later saying that I could get out of it due to getting my phone before June 28, 2008. There are other criteria for this, so make sure you ask, and stick to your guns.
I personally have had nothing but problems with T-Mobile (like having to replace my phone 3 times in a year due to it malfunctioning) and I made them well known.
